旅客和行李运输一般条款

在阅读这些条款时,请注意以下术语的含义:

  • “我们”、“我们的”、“我们自己”和“我们公司”指的是泰国国际航空公司。

  • “您”、“您的”和“您本人”指的是根据机票搭乘或将要搭乘飞机的任何人员,不包括机组成员。(另请参阅“乘客”的定义)

  • “约定中途停留地”指除出发地和目的地以外,在机票中列明或我们时间表中显示为您航线上的预定停靠点的地点。

  • “航空公司识别代码”指用于识别特定航空公司的两个字母或三个字母的代码。

  • “授权代理”指我们委任的、代表我们销售航空运输服务的旅客销售代理人。

  • “行李”指与您的行程相关随身携带的个人物品,除非另有说明,包括托运行李和未托运行李。

  • “行李票”指与托运行李运输相关的机票部分。

  • “行李识别标签”是仅用于识别托运行李的文件。

  • “运输”指通过航空方式运输乘客和/或行李。

  • “承运人附加费用”指由承运人加收的费用,例如燃油附加费、安全附加费、服务费用等。

  • “承运人”指除我们以外的,在您的机票或联程机票上其航空公司识别代码出现的航空承运人。

  • “托运行李”指由我们接收并为其出具了行李票的行李。

  • “办理登机手续截止时间”指航空公司规定的,您必须完成办理手续并领取登机牌的最后时间。

  • “运输合同条款”指包含在机票或行程单/收据中的声明,标明为该名称,并通过引用包含本运输条款及通知。

  • “代码共享”指一个承运人运营的航班,由另一个承运人以其航空公司识别代码单独或与运营承运人的代码共同销售座位的安排。

  • “联程机票”指与另一张机票相关联发给您的机票,两者共同构成一个运输合同。

  • “公约”指下列适用的公约之一:

    • 1929年10月12日签署的《统一国际航空运输某些规则的华沙公约》;

    • 1955年9月28日《海牙议定书》修订的华沙公约;

    • 1975年《蒙特利尔第一号附加议定书》修订的华沙公约;

    • 《海牙议定书》和1975年《蒙特利尔第二号附加议定书》修订的华沙公约;

    • 《海牙议定书》和1975年《蒙特利尔第四号附加议定书》修订的华沙公约;

    • 1961年《瓜达拉哈拉补充公约》;

    • 1999年《蒙特利尔公约》。

  • “客票联”指纸质航段联票或电子联票,每张联票允许持票人搭乘所列的特定航班。

  • “损害”包括对乘客的死亡、受伤或身体伤害,以及因运输或与运输相关的服务所引起或相关的财物丢失、部分丢失、盗窃或其他损坏。

  • “日”指日历日,包括一周中的七天;但用于通知的情况时,不计算通知发出之日;用于计算机票有效期时,不计算出票或航班起飞之日。

  • “电子联票”指保存在我们数据库中的电子航段联票或其他有价凭证。

  • “电子客票”指我们或代表我们签发的行程单/收据、电子联票以及(如适用)登机凭证。

  • “特殊情况”指即使采取了一切合理措施也无法避免的事件。例如:政治不稳定、与航班运行不兼容的气象状况、安全风险、突发飞行安全问题、影响运营承运人的罢工,或空中交通管理的决定导致特定航班长时间延误或取消。

  • “航段联票”指在纸质机票上标有“可用于运输”的部分,或在电子机票中为电子联票,表明您可搭乘的特定航段。

  • “不可抗力”指您无法控制的异常且不可预见的情况,即使尽到所有应有注意也无法避免其后果。

  • “直系亲属”指您的配偶或同居伴侣、父母、子女、兄弟姐妹、祖父母、孙子女、公婆、岳父母、兄弟姐妹的配偶、儿媳或女婿。

  • “行程单/收据”指我们向使用电子机票的乘客出具的、包含乘客姓名、航班信息和通知的文件。

  • “非承运人附加费用”指由非承运人(通常为政府机关或机场)征收的费用,例如机场税、乘客附加费等。

  • “运输合同条款引用通知”指包含在机票或行程单/收据中的声明,标明为该名称,并通过引用包含本运输条款及通知。

  • “乘客”指根据机票搭乘或将要搭乘飞机的任何人员,不包括机组成员。(另见“您”、“您的”和“您本人”的定义)

  • “乘客联”或“乘客收据”指由我们或代表我们签发的、标明为该名称的机票部分,应由您保留。

  • “条例 (EC) 261/2004”指欧洲议会和理事会于2004年2月11日颁布的,关于航班拒载、取消或长时间延误情况下对乘客赔偿和援助的统一规则条例。

  • “特别提款权”是国际货币基金组织定义的一种国际记账单位,基于几种主要货币的价值。特别提款权的币值每日计算,金融界普遍了解,并在主流财经刊物中定期公布。

  • “中途停留”指在出发地和目的地之间、行程中预定停留至少24小时的地点。

  • “运价”指航空公司公布的票价、费用及/或相关运输条款,并在必要时向主管部门备案。

  • “机票”指“乘客机票与行李票”或电子机票,无论是哪一种,均由我们或代表我们签发,并包括运输合同条款、通知及联票。

  • “未托运行李”指除托运行李之外的您的任何行李。

除第2.2、2.3、2.4 和 2.5条另有规定外,本运输条款仅适用于我们在法律上可能对您承担责任的航班或航段。

2.2 包机业务

如果运输是根据包机协议进行的,则本运输条款仅在该包机协议或机票中通过引用或其他方式纳入的范围内适用。

2.3 代码共享

在某些航班服务中,我们可能与其他承运人达成所谓的“代码共享”协议。这意味着,即使您是通过我们预订的航班并且持有标明我们名称或航空公司识别代码的机票,实际执飞航班的可能是另一家承运人。如果在代码共享航班中我们被列为实际承运人,则本运输条款同样适用于该运输。

若适用此类安排,我们将在您预订时告知您航班的实际承运人。

对于由其他承运人执飞的代码共享航班,我们对整个代码共享行程中适用于乘客的所有义务负责。但每家代码共享合作伙伴在其运营的航班方面可能有不同于我们规定的条款,这些条款通过引用纳入本运输条款,构成本运输条款的一部分。

例如:

  • 办理登机手续的截止时间;

  • 无成人陪伴未成年人的运输;

  • 动物运输;

  • 拒绝运输的条件;

  • 氧气服务;

  • 异常运营处理;

  • 拒绝登机的赔偿;

  • 行李接收、行李额及责任等事项。

关于我们代码共享合作伙伴的规则和规定,请查阅其官方网站或咨询您的旅行社。

您应了解由其他承运人根据代码共享协议执飞的航班所适用的规则,包括登机要求、无陪伴未成年人政策、动物运输、拒载规定、氧气服务、异常状况处理、拒绝登机的赔偿以及行李接收等方面。

如果您的航班是在美国境内机场起飞或抵达,只有当该航班由我们执飞时,我们的“延误停机坪应对计划”才适用于您的航班。如果您的航班由代码共享合作伙伴或其他承运人执飞,则适用该实际承运人的延误计划。

2.4 优先适用的法律

除非与我们的运价或适用法律不一致,本运输条款适用;如有不一致,则应以该等运价或法律为准。

如果本运输条款的任何规定根据适用法律无效,其余条款仍然有效。

2.5 条款优先于其他规定

除本运输条款中另有规定外,如本运输条款与我们可能有的其他针对特定事项的规定之间存在不一致,应以本运输条款为准。

2.5.1 加拿大境内/往返加拿大运输

本运输条款仅在被纳入加拿大有效运价表的范围内,适用于加拿大境内或加拿大与其他国家之间的航空运输。

2.5.2 美国境内/往返美国运输

本运输条款不适用于《1958年美国联邦航空法》定义的航空运输。

3.1 一般规定

3.1.1 我们只为机票上所列的乘客提供运输服务,您可能需要出示有效身份证明。

3.1.2 除非受当地适用法律的要求,机票不得转让。此外,如果您的机票是作为适用于《1992年旅游套餐、度假套餐和旅游团条例》(法规号 SI 1992/3288,含修订) 的旅游套餐的一部分出票的,在您提出请求的情况下,我们可为他人重新签发机票,以替代您的原机票,但需满足以下条件:

  • 3.1.2.1 您希望根据上述条例第10条将预订转让给他人;

  • 3.1.2.2 您向我们证明您已满足该条例第10条的所有要求,并有权转让该预订;

  • 3.1.2.3 您在出发日前提前合理通知我们您希望转让该预订;

  • 3.1.2.4 您向我们提供新乘客的姓名、地址及联系方式;

  • 3.1.2.5 您将原机票交还我们;

  • 3.1.2.6 您支付我们合理的行政费用以重新签发机票。

3.1.3 某些票价为折扣价,这些机票可能部分或完全不可退票。您应根据自身需要选择合适的票价,并可考虑购买保险以应对取消行程的情况。

3.1.4 如果您持有如上所述的完全未使用的机票,并因不可抗力而无法出行,在您及时通知我们并提供相关证据的前提下,我们可将该不可退金额作为未来乘机的抵用额度,扣除合理的行政费用后使用。

3.1.5 机票始终为出票承运人的财产。

3.1.6 除电子机票外,您必须出示有效机票,其中包含该航班的航段票和所有未使用的航段票及乘客联,方可乘机。如果所持机票被损坏或未经我们或授权代理人擅自更改,您也无权乘机。对于电子机票,您需出示有效身份证明,且必须已正确以您的名字签发。

3.1.7(a) 如果您遗失或损坏了机票(或部分机票),或无法出示包含乘客联和所有未使用航段联的机票,我们将在有充足证据表明您已为相关航班签发有效机票的情况下,应您请求签发新机票,前提是您签署协议,同意补偿我们或其他承运人因机票误用而实际合理产生的损失和费用,最高不超过原机票金额。若因我们自身疏忽造成的损失,我们将不向您索赔。除非损坏或遗失是由我们或授权代理人的过失造成,否则出票承运人可收取合理的行政费用。

3.1.7(b) 如果无法提供上述证据或您拒绝签署该协议,重新出票的承运人可要求您支付新机票的全额票价;若原出票承运人确认原机票在有效期内未被使用,将予以退款。若您在有效期内找回原机票并交还给承运人,将在当时办理退款。

3.1.8 机票具有价值,请妥善保管,避免遗失或被盗。

3.2 有效期

3.2.1 除非机票、运输条款或适用运价另有规定(其中可能对机票有效期作出限制,并在机票上注明),机票有效期为:

  • (a) 自出票之日起一年内;或

  • (b) 若首程航段自出票之日起一年内启程,则自首次乘机之日起一年内有效。

3.2.2 若在有效期内您因我们无法确认预订而无法出行,机票有效期将被延长,或根据第10条规定退款。

3.2.3 若您已开始行程但因疾病无法继续旅行,我们可延长机票有效期,直至您康复可出行之日,或我们首个有座位、与原票价服务等级相同的航班起飞之日。您须提供医疗证明。若机票或电子票含有一站或多站中途停留,机票有效期最长可延长三个月。若您有家属同行,我们亦将相应延长其机票有效期。

3.2.4 若乘客在途中不幸去世,其同行人员的机票可修改,取消最短停留或延长期限。若乘客的直系亲属在其旅行期间去世,该乘客及其同行亲属的机票亦可相应修改。修改需提供有效死亡证明,延长期限最长不超过死亡日起45天。

3.3 航段顺序与使用

3.3.1 您所购买的机票仅适用于票面所示从出发地,经同意中途停留地至最终目的地的运输。您支付的票价基于我们的运价表,并对应所列的运输路线,这是我们与您签订合同的基本条款。若您未按机票上规定顺序使用所有航段,机票将失效且不予承认,机票必须全部使用。

3.3.2 若您希望更改行程中的任何部分,须提前与我们联系。我们将重新计算票价,您可选择接受新票价或维持原定行程。若因不可抗力需要更改行程,您须尽快与我们联系,我们将合理努力将您运送至下一个中途停留地或最终目的地,而无需重新计算票价。

3.3.3 若您未征得同意而更改行程,我们将重新计算实际行程的应付票价,您需补足差额。若新票价低于原票价,我们将退还差额,但未使用的航段票则不具任何价值。

3.3.4 请注意,并非所有更改都会导致票价变化,但某些更改如更改出发地(例如未乘坐首段航班)或行程反向,可能会增加费用。许多特价票仅适用于机票上所示的日期和航班,不可更改或仅可在支付附加费的情况下更改。

3.3.5 您机票上的每个航段联都将在已预留座位的日期和航班上按相应服务等级运输。若出票时未指定预订,可根据运价及航班空位情况稍后安排座位。

3.3.6 若您未提前通知我们而未登机,我们可能取消您的回程或后续航班预订。但若您提前通知,我们将不会取消后续航班预订。

3.4 承运人名称与地址

我们在机票中可能使用航空公司识别代码或其他方式缩写公司名称。我们的地址为:

4.1 票价

票价仅适用于从出发地机场至目的地机场之间的航空运输,除非另有明确说明。票价不包括机场之间或机场与市区航站之间的地面交通服务费用。
您的票价将根据您付款当天生效的运价表(Tariff)计算,并适用于机票上所示的具体日期和行程。如果您更改行程或出行日期,票价可能会有所变动。
若您在预订时尚未支付机票款项,则付款日期视为您与我们约定付款方式的日期。

4.2 税费和附加费用

您需支付由政府或其他主管机构,或由机场运营方征收的适用税费和附加费用。在您购买机票时,我们会告知所有不包含在票价中的适用税费和费用,这些费用通常会在机票上单独列出。
航空旅行中适用的税费和附加费用可能随时发生变化,并可能在机票签发后新增。如机票上所列的任何税费或附加费用在出票后上涨,您需补交差额。同样,如在出票后新增了新的税费或费用,您也需支付。
如果您在出票时已支付的税费在之后被取消或减少,以致不再适用于您或应付金额减少,您有权申请退款。我们保留对该类退款收取合理行政费用的权利。

4.2.1 所有由承运人和非承运人收取的附加费,您均须支付。

4.3 币种

票价、税费及附加费用应以出票所在国家的货币支付,除非我们或授权代理人在付款时或之前指定了其他货币(例如由于当地货币不可兑换)。我们也可自行决定接受其他币种付款。

5.1 预订要求

5.1.1 我们或我们的授权代理将记录您的预订。根据您的要求,我们将向您提供书面的预订确认信息。
5.1.2 某些票价附带限制条件,可能限制或取消您更改或取消预订的权利。


5.2 出票时限

如果您未在我们或授权代理告知的指定出票时限前支付票款,我们可能会取消您的预订。


5.3 个人资料

您承认,您向我们提供个人资料的目的包括:预订、购票、获取附加服务、开发和提供服务、协助办理入境和移民手续,以及为与您的旅行相关的事项向政府机构提供数据。为实现上述目的,您授权我们保留、使用并传送这些数据给我们的办事机构、授权代理、政府机构、其他承运人或上述服务的提供方。


5.4 座位安排

我们将尽力满足您预先选座的请求,但无法保证提供特定座位。我们保留在任何时间分配或重新分配座位的权利,即使您已经登机。此类变动可能因操作、安全或保安原因而有必要。


5.5 预订的重新确认

5.5.1 后续或返程航段的预订可能需要在规定时间内进行重新确认。我们会告知您何时需要重新确认、如何确认以及在何处进行。如果需要重新确认而您未按要求进行,我们可能取消您的后续或返程航段预订。不过,如果您告知我们您仍希望旅行,且航班上有空位,我们会恢复您的预订并安排运输。如果无空位,我们将尽合理努力将您运送至下一站或最终目的地。

5.5.2 您应自行了解行程中涉及的其他承运人是否要求重新确认预订。如有需要,您必须向机票上显示该航班代码的承运人进行重新确认。


5.6 取消后续预订

请注意,如果您未提前通知我们而未登机,我们可能会取消您的返程或后续航段预订。但如果您提前通知我们,您的后续航班预订将不会被取消。

 

6.1 办理登机手续的截止时间

每个机场的办理登机手续截止时间各不相同,我们建议您提前了解并遵守这些截止时间。如果您预留充足时间以遵守截止时间,您的旅行会更顺利。若您未按规定的截止时间办理登机手续,我们有权取消您的预订。我们或我们的授权代理将告知您第一段航程的登机手续截止时间。至于旅程中的后续航班,您应自行了解其办理登机手续的截止时间。我们航班的截止时间可在我们的航班时刻表中查阅,或向我们或我们的授权代理获取。

6.2 您必须在办理登机手续时我们指定的时间之前,抵达登机口。

6.3 如果您未能按时到达登机口,我们可能会取消为您保留的座位。

6.4 因您未遵守本条款规定而造成的任何损失或费用,我们不承担任何责任。

 

7.1 拒绝承运的权利

在合理行使我们的自由裁量权的情况下,如果我们已书面通知您,自该通知日期起我们将不再承运您乘坐我们的航班,我们有权拒绝承运您或您的行李。在此情况下,您有权获得退款。如果发生以下一种或多种情况,或我们有合理理由相信可能发生以下情况,我们也可以拒绝承运您或您的行李:

7.1.1 为遵守任何适用的政府法律、法规或命令而必须采取此类行动;
7.1.2 承运您或您的行李可能危及或影响其他乘客或机组人员的安全、健康,或在实质上影响其舒适度;
7.1.3 您的精神或身体状态,包括因酒精或药物影响而导致的行为,可能对您自身、其他乘客、机组人员或财产造成危险或风险;
7.1.4 您拒绝接受安全检查;
7.1.5 您未支付适用的票价、税费或附加费用;
7.1.6 您未持有有效的旅行证件、可能试图进入您仅作为过境的国家或无有效证件的目的地国家,或在飞行途中销毁旅行证件,或在被要求交出旅行证件给机组人员收取并出具收据时拒绝配合;
7.1.7 您出示的机票为非法获得,或并非通过我们或我们的授权代理购得,或已被报失、被盗,或为伪造票据,或您无法证明您是票面上记载的乘客本人;
7.1.8 您未遵守第3.3条所述的关于航段顺序与使用的要求,或您出示的机票经非我们或授权代理擅自更改,或机票已被损坏;
7.1.9 您未遵守我们关于安全或安保的指示;
7.1.10 您在先前航班中曾出现上述行为或不当行为,我们有理由相信您可能再次出现类似行为;
7.1.11 您的行为或状态曾威胁航空公司员工或其他乘客的安全,并可能危及飞机或机组人员的安全。

7.2 特别协助

无人陪伴的儿童、行动不便者、孕妇、患病人士或其他需要特别协助的人士的乘机需经我们事先安排并由我们酌情决定是否接受运输。若残障旅客在购票时告知我们其特别需求并已获我们接受,则我们不得以其残障或特别需求为由而在之后拒绝承运该旅客。

8.1 FREE BAGGAGE ALLOWANCE

You may carry some Baggage, free of charge, subject to our conditions and limitations, which are available upon request from us or our Authorised Agents and are included in our Handling Manual available in our main offices (Passenger Service Department).

8.2 EXCESS BAGGAGE

You will be required to pay a charge for carriage of Baggage in excess of the free Baggage allowance. These rates are available from us upon request and are included in our Handling Manual available in our main offices (Passenger Service Department).

8.3 ITEMS UNACCEPTABLE AS BAGGAGE

       8.3.1 You must not include in your Baggage:

             8.3.1.1  items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations, and in our regulations (further information is available from us on request);

             8.3.1.2  items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from or to;

             8.3.1.3  items which are reasonably considered by us to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regard to, among other things, the type of aircraft being used. Information about unacceptable items is available upon request.

       8.3.2  Firearms and ammunition other than for hunting and sporting purposes are prohibited from carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as Checked Baggage. Firearms must be unloaded with the safety catch on, and suitably packed. Carriage of ammunition is subject to ICAO and IATA regulations as specified in Article 8.3.1.1.

       8.3.3  Weapons such as antique firearms, swords, knives and similar items may be accepted as Checked Baggage, at our discretion, but will not be permitted in the cabin of the aircraft.

       8.3.4  You must not include in Checked Baggage money, jewellery, precious metals, computers, personal electronic devices, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples.

       8.3.5  If, despite being prohibited, any items referred to in Articles 8.3.1, 8.3.2 and 8.3.4 are included in your Baggage, any Damage to such items will be subject to the limitations of liability contained in the applicable Convention. We shall have not liability where Damage resulted from the inherent defect, quality or vice of the Baggage.

       8.3.6  Except as the applicable Convention or other law may otherwise require, we are not liable for Damage to your Baggage caused by property contained in the Baggage. Any passenger’s property causes Damage to another Passenger’s Baggage or to the property of Thai Airways shall indemnify us for all losses and expenses incurred by us as a result thereof.

8.4 RIGHT TO REFUSE CARRIAGE

       8.4.1  Subject to Articles 8.3.2 and 8.3.3, we will refuse to carry as Baggage the items described in Article 8.3, and we may refuse further carriage of any such items upon discovery.

       8.4.2  We may refuse to carry as Baggage any item reasonably considered by us to be unsuitable for carriage because of its size, shape, weight, content, character, or for safety or operational reasons, or the comfort of other passengers.        8.4.3  We may refuse to accept Baggage for carriage unless it is in our reasonable opinion properly and securely packed in suitable containers.        8.4.4  Unless advance arrangements for its Carriage have been made with us, we may carry your Baggage, which is in excess of the applicable free allowance, on later flights without any compensation to you for such delay

8.5 RIGHT OF SEARCH

For reasons of safety and security we may request that you permit a search and scan of your person and a search, scan or x-ray of your Baggage. If you are not available, your Baggage may be searched in your absence for the purpose of determining whether you are in possession of or whether your Baggage contains any item described in Article 8.3.1 or any firearms, ammunition or weapons, which have not been presented to us in accordance with Article 8.3.2 or 8.3.3. If you are unwilling to comply with such request we may refuse to carry you and your Baggage. In the event a search or scan causes Damage to you, or an x-ray or scan causes damage to your Baggage, we shall not be liable for such Damage unless due to our fault or negligence.

8.6 CHECKED BAGGAGE

       8.6.1  Upon delivery to us of your Baggage which you wish to check we will take custody of, and issue a Baggage Identification Tag for, each piece of your Checked Baggage.

       8.6.2  Checked Baggage must have your name or other personal identification affixed to it.

       8.6.3  Checked Baggage will, whenever possible, be carried on the same aircraft as you, unless we decide for safety, security or operational reasons to carry it on an alternative flight. If your Checked Baggage is carried on a subsequent flight we will deliver it to you, unless applicable law requires you to be present for customs clearance.

8.7 UNCHECKED BAGGAGE

       8.7.1  We may specify maximum dimensions and/or weight for Baggage which you carry on to the aircraft. If we have not done so, Baggage which you carry onto the aircraft must fit under the seat in front of you or in an enclosed storage compartment in the cabin of the aircraft. If your Baggage cannot be stored in this manner, or is of excessive weight, or is considered unsafe for any reason, it must be carried as Checked Baggage.

       8.7.2  Objects not suitable for carriage in the cargo compartment (such as delicate musical instruments), and which do not meet the requirements in Article 8.7.1 above, will only be accepted for carriage in the cabin compartment if you have given us notice in advance and permission has been granted by us. You may have to pay a separate charge for this service.

8.8 COLLECTION AND DELIVERY OF CHECKED BAGGAGE

       8.8.1  Subject to Article 8.6.3, you are required to collect your Checked Baggage as soon as it is made available at your destination or Stopover. Should you not collect it within a reasonable time, we may charge you a storage fee. Should your Checked Baggage not be claimed within three (3) months of the time it is made available, we may dispose of it without any liability to you.

       8.8.2  Only the bearer of the Baggage Check and Baggage Identification Tag is entitled to delivery of the Checked Baggage.

       8.8.3 If a person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of a Baggage Identification Tag, we will deliver the Baggage to such person only on condition that he or she establishes to our satisfaction his or her right to the Baggage.

8.9 ANIMALS

If we agree to carry your animals they will be carried subject to the following conditions:

       8.9.1  You must ensure that animals, dogs and cats only, are properly crated and accompanied by valid health and vaccination certificates, entry permits, and other documents required by countries of entry or transit failing which, they will not be accepted for carriage. Such carriage may be subject to additional conditions specified by us, which are available on request.

       8.9.2  If accepted as Baggage, the animal, together with its container and food, shall not be included in your free Baggage allowance, but shall constitute excess baggage, for which you will be obliged to pay the applicable rate.

       8.9.3  Guide dogs accompanying Passengers with disabilities will be carried free of charge in addition to the normal free baggage allowance, subject to conditions specified by us, which are available on request.

       8.9.4  Where carriage is not subject to the liability rules of the Convention, we are not responsible for injury to or loss, sickness or death of an animal which we have agreed to carry unless we have been negligent.

       8.9.5  We will have no liability in respect of any such animal not having all the necessary exit, entry, health and other documents with respect to the animal's entry into or passage through any country, state or territory and the person carrying the animal must reimburse us for any fines, costs, losses or liabilities reasonably imposed or incurred by us as a result.

8.10 ITEMS REMOVED BY AIRPORT SECURITY PERSONNEL

We will not be responsible for, or have any liability in respect of, articles removed from your Baggage by airport security personnel acting in accordance with any applicable regulations.

9.1 SCHEDULES

       9.1.1  The flight times shown in timetables may change between the date of publication and the date you actually travel. We do not guarantee them to you and they do not form part of your contract with us.

       9.1.2  Before we accept your booking, we will notify you of the scheduled flight time in effect as of that time, and it will be shown on your Ticket. It is possible we may need to change the scheduled flight time subsequent to issuance of your Ticket. If you provide us with contact information, we will endeavour to notify you of any such changes. If, after you purchase your Ticket, we make a significant change to the scheduled flight time, which is not acceptable to you, and we are unable to book you on an alternate flight which is acceptable to you, you will be entitled to a refund in accordance with Article 10.2.

9.2 CANCELLATION, REROUTING, DELAYS, ETC.

       9.2.1  We will take all necessary measures to avoid delay in carrying you and your Baggage. In the exercise of these measures and in order to prevent a flight cancellation, in exceptional circumstances we may arrange for a flight to be operated on our behalf by an alternative carrier and/or aircraft.

       9.2.2  Except as otherwise provided by the Convention, if we cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at your destination or Stopover destination, or cause you to miss a connecting flight on which you hold a confirmed reservation, we shall, at your option, either:

             9.2.2.1  carry you at the earliest opportunity on another of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of your Ticket; or

             9.2.2.2  within a reasonable period of time re-route you to the destination shown on your Ticket by our own services or those of another carrier, or by other mutually agreed means and class of transportation without additional charge. If the fare and charges for the revised routing are lower than what you have paid, we shall refund the difference; or

             9.2.2.3  make a refund in accordance with the provisions of Article 10.2.

       9.2.3 Upon the occurrence of any of the matters set out in Article 9.2.2, except as otherwise provided by the Convention, the options outlined in Article 9.2.2.1 to 9.2.2.3 are the sole and exclusive remedies available to you and we shall have no further liability to you.

       9.2.4  If we are unable to provide previously confirmed space, we shall provide compensation to those Passengers denied boarding in accordance with applicable law and our denied boarding compensation policy. A copy of our denied boarding compensation policy is available upon request.

Person to whom Refund will be made

10.1 We will refund a Ticket or any unused portion, in accordance with the applicable fare rules or Tariff, as follows:

       10.1.1  Except as otherwise provided in this Article, we shall be entitled to make a refund either to the person named in the Ticket or to the person who has paid for the Ticket, upon presentation of satisfactory proof of such payment.

       10.1.2  If a Ticket has been paid for by a person other than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on refund, we shall make a refund only to the person who paid for the Ticket, or to that person's order.

       10.1.3  Except in the case of a lost Ticket, refunds will only be made on surrender to us of the Ticket and all unused Flight Coupons.

10.2 INVOLUNTARY REFUNDS

       10.2.1  If we cancel a flight, fail to operate a flight reasonably according to schedule, fail to stop at your destination or Stopover, or cause you to miss a connecting flight on which you hold a reservation, the amount of the refund shall be:

             10.2.1.1  if no portion of the Ticket has been used, an amount equal to the fare paid;

             10.2.1.2  if a portion of the Ticket has been used, the refund will be not less than the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used.

10.3 VOLUNTARY REFUNDS

       10.3.1  If you are entitled to a refund of your Ticket for reasons other than those set out in 10.2, the amount of the refund shall be:

             10.3.1.1   if no portion of the Ticket has been used, an amount equal to the fare paid, less any reasonable service charges or cancellation fees;

             10.3.1.2  if a portion of the Ticket has been used, the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less any reasonable service charges or cancellation fees.

10.4 REFUND ON LOST TICKET

       10.4.1  If you lose your Ticket or portion of it, upon furnishing us with satisfactory proof of the loss, and payment of a reasonable administration charge, refund will be made as soon as practicable after the expiry of the validity period of the Ticket, on condition:

             10.4.1.1  that the lost Ticket, or portion of it, has not been used, previously refunded or replaced (except where the use, refund or replacement by or to a third party resulted from our own negligence).

             10.4.1.2  that the person to whom the refund is made undertakes, in such form as may be prescribed by us, to repay to us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it is used by a third party (except where any fraud or use by a third party resulted from our own negligence).

       10.4.2  If we or our Authorised Agent lose the Ticket or a portion of it, the loss shall be our responsibility.

10.5 RIGHT TO REFUSE REFUND

       10.5.1  We may refuse a refund where application is made after the expiry of the validity of the Ticket.

       10.5.2  We may refuse a refund on a Ticket which has been presented to us, or to Government officials, as evidence of intention to depart from that country, unless you establish to our satisfaction that you have permission to remain in the country or that you will depart from that country by another carrier or another means of transport.

10.6 CURRENCY

All refunds will be subject to government laws, rules and regulations or orders of the country in which the ticket was originally purchased and of the country in which the refund is being made. Subject to the foregoing provision, we reserve the right to make a refund in the same manner and the same currency used to pay for the Ticket.

10.7 BY WHOM TICKET REFUNDABLE

Voluntary refunds will be made only by the carrier which originally issued the Ticket or by its agent if so authorized.

11.1 GENERAL

If, in our reasonable opinion, you conduct yourself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew, we may take such measures as we deem reasonably necessary to prevent continuation of such conduct, including restraint. You may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.

11.2 PAYMENT OF DIVERSION COSTS

If, as a result of conduct by you of the sort mentioned in Article 11.1 we decide, in the exercise of our reasonable discretion, to divert the aircraft for the purpose of offloading you, you must pay all costs resulting from that diversion.

11.3 ELECTRONIC DEVICES

For safety reasons, we may forbid or limit operation aboard the aircraft of electronic equipment, including, but not limited to, cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.

12.1

If we make arrangements for you with any third party to provide any services other than carriage by air, or if we issue a ticket or voucher relating to transportation or services (other than carriage by air) provided by a third party such as hotel reservations or car rental, in doing so we act only as your agent. The terms and conditions of the third party service provider will apply. We shall have no liability to you for such services except for negligence on our part in making such arrangements.

12.2

If we are also providing surface transportation to you, other conditions may apply to such surface transportation. Such conditions are available from us upon request.

             10.4.1.1  that the lost Ticket, or portion of it, has not been used, previously refunded or replaced (except where the use, refund or replacement by or to a third party resulted from our own negligence).

             10.4.1.2  that the person to whom the refund is made undertakes, in such form as may be prescribed by us, to repay to us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it is used by a third party (except where any fraud or use by a third party resulted from our own negligence).

13.1 GENERAL

       13.1.1  You are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which you transit.

       13.1.2  We shall not be liable for the consequences to any Passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.

13.2 TRAVEL DOCUMENTS

Prior to travel, you must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take and retain copies thereof. We reserve the right to refuse carriage if you have not complied with these requirements, or your travel documents do not appear to be in order.

13.3 REFUSAL OF ENTRY

If you are denied entry into any country, you will be responsible to pay any fine or charge assessed against us by the Government concerned and for the cost of transporting you from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by us.

13.4 PASSENGER RESPONSIBLE FOR FINES, DETENTION COSTS, ETC.

If we are required to pay any fine or penalty or to incur any expenditure by reason of your failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, you shall reimburse us on demand, any amount so paid or expenditure so incurred. We may apply towards such payment or expenditure the value of any unused carriage on your ticket, or any of your funds in our possession.

13.5 CUSTOMS INSPECTION

If required, you shall attend inspection of your Baggage, by customs or other Government officials. We are not liable to you for any loss or damage suffered by you in the course of such inspection or through your failure to comply with this requirement.

13.6 SECURITY INSPECTION

You shall submit to any security checks by Governments, airport officials, Carriers or by us.

Carriage to be performed by us and other Carriers under one Ticket or a Conjunction Ticket is regarded as a single operation for the purposes of the Convention. However, your attention is drawn to Article 15.1.2(b)

15.1 APPLICABILITY

The liability of each carrier involved in your journey will be determined by its own conditions of carriage. Our liability provisions are as follows:

15.1.1  Where your carriage is not subject to the liability rules of the Convention, the following rules shall apply:

15.1.1(a) Death of or Injury to Passengers

Our liability for damages sustained in the event of death, wounding or any other bodily injury by a Passenger in the event of an accident shall not be subject to any financial limit, be it defined by law, Convention or contract.

Any damages up to the sum of the equivalent of 128,821 Special Drawing Rights, we shall not exclude or limit our liability by proving that we and our agents have taken all necessary measures to avoid the damage or that it was impossible for us or our agents to take such measures.
Notwithstanding the provisions of the previous paragraph, if we prove that a) such damage was not due to the negligence or other wrongful act or omission of or our servants or agents; or b) such damage was solely due to the negligence or other wrongful act or omission of a third party , we may be exonerated wholly or partly from our liability in accordance with applicable law.

15.1.1(b) Advance Payments

If a Passenger is killed or injured, we shall make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16,000 SDRs. An advance payment shall not constitute a recognition of liability and may be offset against any subsequent sums paid on the basis of our liability, but is not returnable, except in the cases prescribed in paragraph 15.1.2 (a), or in circumstances where it is proved that the person who received the advance payment caused or contributed to the Damage by negligence, or that he was not entitled to such compensation.

15.1.1 (c) Passenger delays

In case of Passenger delay, we are liable for Damage unless we took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for Passenger delay is limited to 5,346 SDRs.

15.1.1 (d) Destruction, loss or other Damage to Baggage and Baggage delays

In the case of Checked Baggage, we are liable even if not at fault, unless the Baggage was defective, In the case of Uncheck Baggage, we are liable only if at fault, In case of Baggage delay, we are liable for Damage unless we took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability in the case of destruction, loss or other Damage to Baggage or Baggage delay is limited to 1,288 SDRs per Passenger.

15.1.1 (e) Flight delays

In the event of a flight cancellation or delay, and if the Passenger has a contact number, email address or emergency contact in their booking record , the Carrier will implement all the provisions of the relevant applicable regulations.

15.1.2 Other terms and disclaimers;

       15.2.1 (a)  Any liability we have for Damage, will be reduced by any negligence on your part which causes or contributes to the Damage in accordance with applicable law.

       15.1.2 (b)  We will be liable only for Damage occurring during carriage on flights or flight segments where our Airline Designator Code appears in the carrier box of the Ticket for that flight or flight segment. If we issue a Ticket or if we check baggage for carriage on another Carrier, we do so only as agent for the other Carrier. Nevertheless, with respect to Checked Baggage, you may make a claim against the first or last carrier or against the carrier performing the carriage during which the damage took place.

       15.1.1(c)  We are not liable for any Damage arising from our compliance with or your failure to comply with applicable laws or Government rules and regulations.

       15.1.1(d)  Except where other specific provision is made in these Conditions of Carriage, we shall be liable to you only for recoverable compensatory damages for proven losses and, to the extent permitted by applicable law, you agree that we shall not be liable for indirect, consequential, or any other form of non-compensatory damages.

       15.1.1 (e)  We are not liable for any Damage caused by your Baggage. You shall be responsible for any Damage caused by your Baggage to other persons or property, including our property.

       15.1.1 (f)  You must not pack in your Checked Baggage articles not permitted to be contained in Checked Baggage under Article 8.3, including fragile or perishable items, items having a special value or personal essential items, such as money, jewelry precious metals, computers, cameras, cellular telephones, personal electronic devices, musical instruments, glasses/sunglasses, keys, medicines, negotiable papers, securities, or other valuables, share certificates, bonds and other valuable documents, business documents, passports and other identification documents, or samples. Your right to recover damages for their destruction, loss or other Damage will be limited under the applicable Convention.

       15.1.1 (g)  We are not responsible for any illness, injury or disability, including death, attributable to your physical condition or for the aggravation of such condition.

       15.1.1 (h)  The contract of carriage, including these Conditions of Carriage and exclusions or limits of liability, applies to our Authorised Agents, servants, employees and representatives to the same extent as it applies to us. The total amount recoverable from us and from such Authorised Agents, employees, representatives and persons shall not exceed the amount of our own liability, if any.

       15.1.1 (i)  Nothing in these Conditions of Carriage shall waive any exclusion or limitation of our liability or any defence available to us under the Convention or applicable laws unless otherwise expressly stated.

15.2 WARSAW CONVENTION AND MONTREAL CONVENTION

Unless otherwise stated herein, international carriage, as defined in the Convention, is subject to the liability rules of the Convention.

16.1 NOTICE OF CLAIMS

Acceptance of Baggage by the bearer of the Baggage Check without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage, unless you prove otherwise.

If you wish to file a claim or an action regarding Damage to Checked Baggage, you must notify us as soon as you discover the Damage, and at the latest, within seven (7) Days of receipt of the Baggage. If you wish to file a claim or an action regarding delay of Checked Baggage, you must notify us within twenty-one (21) Days from the date the Baggage has been placed at your disposal. Every such notification must be made in writing.

16.2 LIMITATION OF ACTIONS

Any right to damages shall be extinguished if an action is not brought within two years of the date of arrival at destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. The method of calculating the period of limitation shall be determined by the law of the court where the case is heard.

Carriage of you and your Baggage is also provided in accordance with certain other regulations and conditions applying to or adopted by us. These regulations and conditions as varied from time to time are important. They concern among other things:

(i) the carriage of unaccompanied minors, pregnant women, and sick passengers,
(ii) restrictions on use of electronic devices and items; (iii) the on board consumption of alcoholic beverages.
Regulations concerning these matters are available from us upon request.

The title of each Article of these Conditions of Carriage is for convenience only, and is not to be used for interpretation of the text.

None of our Authorised Agents, servants,employees or representatives has authority to alter, modify or waive any provision of these Conditions of Carriage.
